The rules by which you must abide by in order to use our services and products
Please note that, KreativeInc Agency Ltd reviews and updates this Terms & Conditions Policy from time to time as needed without notice. 1. Product Descriptions and Pricing
KreativeInc Agency (the “Company”) endeavours to describe our services and/or products as accurately as possible. While we try to be as clear as possible in explaining our services or products, please do not accept that the Site is entirely accurate, current, or error-free. From time to time we may correct errors in pricing and descriptions. And we reserve the right to refuse or cancel any order with an incorrect price listing.
2. Refusal of Service.
The Services are offered subject to our acceptance of your order or requests. We reserve the right to refuse service to any order, person or entity, without the obligation to assign a reason for doing so. No order is deemed accepted by us until payment has been processed. We may at any time change or discontinue any aspect or feature of the Site or Service, subject to us fulfilling our previous responsibilities to you based on acceptance of your payment.
We accept payment by bank transfer and PayPal. We reserve the right to charge a fee of 3.5% of the total project fee for PayPal transactions. All quotes are priced in British Pounds Sterling. All quotes/estimates are valid for 30 days only. All quotes/estimates are subject to change depending on the client brief, artwork supplied to us and the complexity of each individual job.
For new websites, payment is required as 50% up-front, 25% on approval of the designs and 25% on approval of your staging website by the dates agreed. For other work, all clients are charged at 100% upfront for pre-quoted jobs. In the event of orders being cancelled or suspended, we require written confirmation and payment in full for the portion of work completed and for the materials used to date. All digitised imagery, logos and basic text are to be supplied by the client or purchased separately through KreativeInc Agency.
For our services or products that require regular payment, we accept payment by standing order. If you set up a standing order with your bank you hereby represent and warrant that you are authorised to do so. If your payment method fails or your account is past due, you agree to pay us the fees within thirty (30) days of notification from us and pay (at our discretion) a late payment charge of 1.5% per month, or the maximum permitted by law, whichever is greater. We may collect fees owed using other collection mechanisms. This may include charging other payment methods on file with us and/or retaining collection agencies and legal counsel. We may also block your access to any Services pending resolution of any amounts due by you to KreativeInc Agency.
Once final payment has been received, the website design ownership is transferred to you (with the exception of any licensed fonts or stock images that have been supplied by KreativeInc Agency and not purchased separately). KreativeInc Agency retains and reserves the rights to use any and all content developed, regardless of ownership, for display and self-promotional purposes. We may include a link to www.kreativeincagency.co.uk in the footer of your website for our marketing.
For any of our educational resources, permission is granted to download one copy of the materials (information or E-book) for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title. This license shall automatically terminate if you violate any of our restrictions and may be terminated by KreativeInc Agency at any time.
5. Processing Orders.
We require a design brief, signature by an approved business representative on our service agreement and 50% payment prior to commencing each job. Clients are required to provide the content for site pages via a Word file format or Dropbox folder which is a shared drive unless otherwise agreed. All site content must be supplied prior to us commencing the website build. Content can include text, images (jpeg, svg, png, gif,), PDF documents, Microsoft Office files, embedded videos (preferably YouTube or Vimeo), acrobat forms, and any other formats supported by the WordPress Content Management System (CMS). If you require extra content, copywriting or stock library images for your site, this can be purchased from KreativeInc Agency separately.
6. Additional Work, Site Updates & Training.
Unplanned components, ideas, revisions, and project scope can sometimes happen. When there is an unexpected or requested addition to design, development, content creation or WordPress training that will incur a cost, we will notify you ahead of time and will not commence the job unless we receive clear approval to proceed and, in some cases, payment in full.
Please note that any liaison with third-party providers requested during revisions or unexpected changes is chargeable at our hourly rate.
To ensure your website is working correctly, we provide a 30-day warranty period from the time your site goes live, where we will update your website for free within the development brief scope.
Please note that compliance with the WCAG 2.1 Level AA Standards is not a “one and done” issue. Because you will be making changes to your site, possibly including text, images, video and navigation, and because of changes made to browsers, plugins, assistive technology and much more, you must maintain standards compliance through upkeep and regular checks. We recommend that you have a monthly, quarterly and/or annual standards compliance maintenance plan for your website.
We are not responsible for the standards compliance of third-party plugins or third-party software that are installed on your website currently or in the future. We are unable to make changes to their platforms. This needs to be done by them.
9. On-going Support.
We want you to get the most out of your new website and for it to be a fully integrated online business solution. To help you achieve this we can offer an assortment of ongoing maintenance, accessibility audits and certification as well as training that can be purchased separately.
